- PatentsWe support clients in all stages of patent protection, from how to patent an invention to prosecution and enforcement. We also render patentability and freedom-to-operate advice and opinions, and help navigate PMPRB regulations. Our team includes one of a handful of patent agents in Canada who have passed both U.S. and Canadian patent agent exams, and who can represent any applicant before both the USPTO and CIPO.
- TrademarksWe assist our clients in all aspects of branding, including the selection, application, filing and registration, maintenance, exploitation, and enforcement of trademarks. We advise on domain names and advertising, infringement issues, international trademark applications and trademark opposition. We provide effective anti-counterfeiting and anti-piracy strategies to assert brand and trademark portfolio protection in Canada and across many jurisdictions.
- Industrial Designs and CopyrightsOur lawyers and agents assist clients domestically and internationally on all matters relating to copyright and industrial designs, including search and clearance opinions, design rights, assignments and licenses, works protected by copyright, and prosecuting and defending copyright claims and infringement. Our broad knowledge of design law also helps protect designs with global application filings.
- Licensing and Joint Ownership AgreementsWe work closely with clients in the due diligence, design and implementation of in-licensing, out-licensing and cross-licensing strategies to exploit IP assets effectively. We structure and negotiate complex joint development, licensing, assignment, and other alliances for the commercialization of IP, including non-disclosure agreements and IP agreements.
- Intellectual Property DisputesWe act as counsel in complex, high-profile patent, trademark, and copyright disputes, before all levels of courts, IP tribunals and regulatory bodies. We have deep knowledge of trade secret and IP right infringement appeals, trials, settlement agreements and alternative dispute resolution methods.
