Torys honoured at 2021 Benchmark Litigation Canada Awards

We are proud to announce that Torys has been named Class Action Firm of the Year, Product Liability Firm of the Year and received the Impact Case of the Year Award at the 2021 Benchmark Litigation Canada Awards.

This marks the second consecutive year Torys has been named Product Liability Firm of the Year by Benchmark Litigation.

Montréal office Managing Partner and head of Torys’ Class Actions and Product Liability national practice groups Sylvie Rodrigue said “it is a privilege to be honoured at this year’s awards. Torys also received the Impact Case of the Year Award for our work in Hydro-Québec v. Louise Matta for successfully representing the Canadian Electricity Association (CEA) in an intervention before the Supreme Court of Canada with a team that included David Outerbridge, Stacey Reisman and Henry Federer.

The issue on appeal was whether the appellant, Hydro-Québec, could construct a new transmission line on private lands subject to decades-old servitudes (rights of way) that were established for a specific construction project in the early 1970s. The CEA intervened to support the right of Hydro-Québec to build the new transmission line. The Supreme Court restored the trial judge’s ruling in favour of Hydro-Québec, finding that while the servitudes at issue had originally been acquired by expropriation,  the subsequent agreements had clarified their purpose and scope, and there was nothing in that description that limited Hydro-Québec’s rights.
