Episode 13: purposive construction, more infringing activities, and the U.S. Bayh-Dole Act

Join Niki and Andy for the second Patently Absurd of 2024 as they revisit the familiar topic of patent construction—this time focusing on how the Courts approach the purposive construction of key phrases in a claim. Returning to the topic of “infringing activities” the duo will also discuss recent FCA guidance on what constitutes the “use” of an invention for the purposes of infringement. Finally, Washington DC-based Chair of the IP, Transactions and Licensing Group at Dinsmore & Shohle LLP, Brian O’Shaughnessy, will join the session to provide a crash course on the U.S. Bayh-Dole Act and the role of government-funded research in patented inventions.
