Patently Absurd, Episode 8: Patent term, conduct before the patent office and patent expertise in the courts

Join Torys' intellectual property lawyers for an informal discussion on all aspects of patent law. We’ll be analyzing the old, the new—and most definitely the absurd—in candid conversation, all while taking questions from the audience and welcoming special guests along the way.

Episode 8: Patent term, conduct before the patent office and patent expertise in the courts

Join Andy and Niki for the first Patently Absurd of 2023. In the eighth episode, for something old, they will discuss patent term—both its history and some thoughts on its future in Canada. For something new, they will discuss the recent Federal Court commentary on patentee conduct before the patent office and its potential consequences in litigation. In the something borrowed section, they will “borrow” from the oft-raised debate about the pros and cons of a specialist patent bench and review the approach that may be taken by the Federal Court of Canada.

Something old: patent term past, present and future
Something new: bad faith in patent prosecution
Something borrowed: thoughts on patent expertise in judges who hear patent cases
