The legal landscape around privilege is continuously shifting, creating challenges for in-house legal teams. This session will provide a refresher on privilege and address some key developments in Canadian privilege law. We will discuss practical tips and advice to assist in-house counsel navigate the complex world of privilege. In particular, we will discuss the following hot topics:

  • What is common-interest privilege (sometimes called “deal team” or “transactional” privilege), and when does it apply?
  • How is privilege maintained, and in what circumstances is it waived? Can privilege be waived through reckless or careless conduct?
  • How do you address privilege in the context of internal investigations?
