Episode 14: ambiguity and patent term adjustment, in theory and practice

After a small hiatus, Niki and Andy are back for the final episode of Patently Absurd for 2024. In this episode, the pair will discuss the concept of “ambiguity” and what recent Court treatment adds to the body of law, as well as Canada’s coming patent term adjustment regime, draft regulations published earlier this year, and the comments that followed.

They will provide a refresher on the origins of the regime and its intended purpose before their colleague and Torys IP lawyer and patent agent, Yu Seon Gadsden-Chung, joins them to talk about practical applications of Canada’s PTA regime and what patent holders can likely expect based on the regulations as drafted.
