Advertising Complaints Now Posted on the Health Canada Website

Food and Drug Regulatory LawThis summer, Health Canada began quarterly updating of a list of all pending and closed investigations related to advertising complaints related to drugs, devices and natural health products. 

In the past, advertising complaints and a company’s response were typically treated as confidential, for example, in the context of an access-to-information request. Companies should be aware that details of complaints, including company name, product, complaint source and enforcement action, will now be made public, and should anticipate access-to-information for additional documents underlying the complaint. Time will tell if this new practice of posting result in changes to corporate practices and/or act as a disincentive to innovative support programs and campaigns for health products.
