Patently Absurd, Episode 19: Patent law update – 2025 in review, infringement by common design, and European oppositions

Speakers

Join Torys' intellectual property lawyers for an informal discussion on all aspects of patent law. We’ll be analyzing the old, the new—and most definitely the absurd—in candid conversation, all while taking questions from the audience and welcoming special guests along the way.

Episode 19: Patent law update – 2025 in review, infringement by common design, and European oppositions

In our first Patently Absurd episode for 2026, Niki and Andy will kick us off with an overview of the influential patent cases from 2025, as well as some stats of interest. They will also discuss some recent case law developments on the newly applied doctrine of infringement by common design. And, finally, they will be joined virtually by Dr. Aleksandra Kuźnicka-Cholewa, IP counsel and attorney-in-law from CMS Poland.

We are pleased to welcome Dr. Aleksandra as our speaker. As a member of the European Commission’s expert group on SEPs and a scholar at the Institute of Law Studies at the Polish Academy of Sciences, she will walk us through the ins and outs of the popular patent opposition process in the EU.

Something old: 2025 in review
Something new: infringement by common design
Something borrowed: European opposition proceedings—Are they useful? Why don’t we have them?
