Breakfast With Appeal: The “beyond a seasonable doubt” edition

There’s not a reasonable person out there who would argue that winter is here, and as the courts wrap up their term and the holidays approach, the Breakfast With Appeal panel is back for their last session of the year with commentary on recent developments. And, in the spirit of the holidays, this December’s BWA packs a punch!

The team will discuss:

  • Annapolis v. Halifax: what does the SCC’s constructive feedback on constructive takings mean for the tension between land use and land use regulation—and the tension within the Court on private law?;
  • R. v. Sharma: since the SCC cited our own section 15 expert Alicja Puchta about s. 15, she’s signed up to join us for a discussion on what “substantive equality” means in the post-Abella era, and whether a majority of the Court has walked back from Fraser; and
  • Quick hits on insolvency, arbitration and patent cases. Because sometimes we find interest in the least suspecting places… if we only did the fun subjects, it wouldn’t be as appealing.
