


As governments across Canada prepare to fast-track “nation-building” infrastructure projects, developers, lenders, construction firms and other stakeholders need to be especially aware of litigation risk, and the importance of building a mitigation strategy into planning from the outset. Join members of our integrated Development and Projects Litigation team for this series, as we describe how we apply a "litigation lens" to reduce risk throughout the project lifecycle, from design and approvals applications through to handling litigation when it arises: before, during, and after construction.
Meaningful involvement of Indigenous communities is crucial to the development of major projects. Project proponents today face evolving legal standards and address multiple inter-related aspects of relationships with Indigenous peoples, which may include the duty to consult and accommodate, UNDRIP and FPIC, reconciliation, the use of traditional Indigenous knowledge, economic benefits and equity participation. Navigating these discussions is key to managing project timelines, controlling costs, completing regulatory processes, and avoiding disputes.
In this session, our speakers—including former Minister of Justice and Attorney General of Canada, and current Torys senior counsel, Arif Virani—will discuss nuances to be aware of in managing these discussions, strategies for effective coordination with government in relation to Indigenous matters, and tools to avoid disputes and keep projects on track.
