Torys’ Appellate Group is back with the Breakfast with Appeal series for 2020. Join the panel for the first session of the year as they discuss some important cases the appellate courts have seen in the last few months.
In particular, the panel wil discuss:
- administrative law in the 2020s: Vavilov and how the SCC changed everything (and nothing) about how governmental decisions are appealed and reviewed;
- good faith in contracting: in two recent appeals, the SCC reconsiders what it really means; and
- whether a government can contract out of legislation, and can legislation cause a breach of contract: the SCC rules on the permissibility of an “indirect fetter”.
