Within our litigation team, Torys has a group of class actions specialists with expertise that extends from pre-certification to trial. We represent clients in a wide range of class actions brought in provinces across the country, including in Québec, and in courts of all levels.
In 2014 Benchmark Canada named Torys Class Action Firm of the Year and praised the firm as having “achieved recognition and a prestigious standing all throughout Canada.” Our class action (defence) practice is also ranked in Band 1 by Chambers Global, one of only four firms in Canada ranked at this highest level.
As one of the very few firms in Canada who has defended multiple class proceedings at trial, we are unique. Our trial and appellate experience is extensive, with experience leading and coordinating the defence and settlement of multijurisdictional class actions nationally and internationally.
Our Approach to Multijurisdictional Actions
Disputes increasingly cross national and provincial boundaries and require that proceedings be conducted and coordinated in several jurisdictions. We have significant expertise dealing with multijurisdictional disputes, routinely representing clients in multiple Canadian jurisdictions and in United States proceedings.
We believe that our litigation practice is unique in Canada due to our integrated team structure. As a result, our class actions team includes lawyers called to multiple Bars with active practices in Québec and the rest of Canada. This means that the same team of lawyers can be counsel, not only on cases filed in Québec, but also on cases filed elsewhere in the country.
This structure results in efficiencies and unmatched consistency and cohesion on strategy for clients in national actions; it also significantly reduces costs. Torys’ approach is a noticeable distinction from other Canadian firms that simply combine independent teams to manage Canadian civil and common law matters.
We serve a wide range of clients, from large financial institutions and industrial corporations to start-up venturers and entrepreneurs. We pride ourselves on effective teamwork with corporate counsel and other external counsel. Our class actions practice includes advising clients on Canadian aspects of U.S. class actions, and providing expert opinion evidence in U.S. class actions concerning various aspects of Canadian law.
Our class actions experience covers a wide range of areas, including:
- product liability, including complex, multijurisdictional class action claims and in individual cases involving products from a broad range of industries.
- consumer protection
- competition and foreign investment review
- life sciences
- information technology
- commercial matters
- pensions and employment
- breach of statute
