Breakfast With Appeal: The “Hotel California” edition

You can check out of Breakfast with Appeal, but you can never leave behind our hot takes on appellate law! Join us on December 10th when our Breakfast with Appeal panel will welcome you with the following cases:

  • Five-star (reasonable) review – In Auer v. Auer, the Supreme Court weighed in on the matter of subordinate legislation, confirming that it is entitled to no more and no less deference than any other administrative decision: a decision which settles a debate for courts of appeal across the country.
  • Reuse your linens, please – In Mathur v. Ontario, the Ontario Court of Appeal has set a unique precedent for climate litigation in Canada, offering insight into how litigants might approach future climate litigation through the lens of Charter-protected rights.
  • Meet me in the lobby – In Democracy Watch v. Canada (Attorney General), the Federal Court provided clarity on the scope and restrictions on judicial review in the context of how the Lobbyists' Code of Conduct is to be reviewed by Parliament or the Courts.
  • Turn-down service? – In Aquino v. Bondfield Construction Co., the Supreme Court issued a landmark decision on the doctrine of corporate attribution and how companies possess knowledge or have intention, in the context of a fraudulent scheme in the Bondfield Group.
