Assaf and associate Marina Chernenko co-authored “The Tervita Decision: Prevention of Competition, Efficiency Defenses, and Knowing the Unknowns in Merger Review,” an article for the American Bar Association’s journal Antitrust. In the article, Dany and Marina analyze Commissioner of Competition v. Tervita Corp, a recent Supreme Court of Canada decision (and the court’s first since 1997 under the Competition Act) that provides important guidance on merger cases in Canada.
