Insights on the landmark Opsis ruling

In an interview with Law360, partner Jeremy Opolsky shared his thoughts on the significant ruling in Opsis Airport Services Inc. v. Quebec (Attorney General), 2025 SCC 17.

“Not only is it an incredibly important case for federally regulated industries, like airlines, railroads and telecoms, but I wouldn’t overlook the fact that it empowers the interprovincial nation-building projects on which the feds have put a premium,” he said.

Jeremy continued to highlight that the ruling reinforces the importance of interjurisdictional immunity, clarifies that “precedent is not determinative,” prioritizes interjurisdictional immunity over paramountcy, and allows courts to consider potential legislative impacts.
