“In cases involving product recalls, the mere fact of behaving like a good corporate citizen by establishing a compensation program is often not enough to prevent a class action," notes Sylvie Rodrigue, litigation partner at Torys.
Sylvie adds that corporations should nevertheless provide for such mechanisms. “The judge will consider them at trial. This sometimes allows for punitive damages to be avoided, but they do not prevent the class action from moving forward.”
