While discussing the looming changes to Canada’s Competition Act with the Global Competition Review (GCR), co-chair of Torys’ Competition and Foreign Investment Review practice and chair/president of the Canadian Bar Association (CBA) Omar Wakil said that the association is “profoundly concerned about the amendment process as well as the substance of the proposals.”
“The changes are being rushed through Parliament without any meaningful consultation or debate,” he added.
GCR reported that Omar did acknowledge the government’s plan to conduct consultations on other potential amendments to the Act in the future.
“There is no good reason why there has to be a two-step process and why all proposals could not have been the subject of consultation,” Omar said.
The CBA has expressed its concerns in writing and in Parliamentary hearings, but ultimately Omar believes amendments will proceed unchanged.
