Andrew Bernstein discusses reputational liability in Mr. Sub class action lawsuit
Litigation partner Andrew Bernstein spoke with The Globe and Mail on a class action lawsuit by Mr. Sub franchisees seeking compensation from Maple Leaf Foods for financial and reputational damage that arose from the 2008 listeriosis crisis. The article brings to light that this case, among many others, “raises a thorny issue in tort law, the body of law that deals with civil negligence”.
“The broader implications of the case are very significant”, Andrew said. “I think the concern you would have is that anybody who supplies anything that’s used in another business could face potential liability”.
The class action appeal between Mr. Sub franchisees and Maple Leaf Foods was set for October 15. The Supreme Court of Canada’s ruling will be determined at a later date.
