Nation Rise Wind Farm
Torys acted as counsel to EDP Renewables Canada in the development and construction of the 100 MW Nation Rise Wind Farm located in eastern Ontario, including the negotiation of its equity partnership arrangements with Algonquins of Pikwàkanagàn First Nation, the project’s renewable energy approval (REA) application, related permitting and approval processes, a power purchase agreement under the 2015 Large Renewable Procurement I program facilitated by the Independent Electricity System Operator, as well as land and municipal road approvals
The wind farm, which covers 12,000 acres of primarily agricultural land 40 km southeast of Ottawa in the municipality of North Stormont, consists of 29 Enercon E-138 3.4 MW turbines generating enough electricity to support the needs of more than 35,000 households.
The facility reached commercial operation in June 2021 and is supported by a 20-year power purchase agreement with the Independent Electricity System Operator.

Torys acted as counsel on the project’s development and construction with a team led by Valerie Helbronner and which included John Terry, Grant Worden, Arlen Sternberg, Stefan Case and Jon Silver (administrative and dispute resolution), Dennis Mahony and Tyson Dyck (environmental).
A Torys team also advised on the sale of a 50.01% partnership interest in the wind farm to an Indigenous partnership owned by the Algonquins of Pikwakanagan First Nation. The team was again led by Valerie Helbronner and included Stephanie Stimpson, Amy Maginley (sale/leaseback), Scott Kraag and Erin Shin (financing), Andy Gibbons and Tristan McLeod (real estate), Andrew Silverman and Benjamin Mann (tax).
