His article, “All Is Not Lost: A Consequential Damages Exclusion May Not Preclude Lost Profits Under New York Law,” provides analysis on a 2014 New York Court of Appeals decision that represents a departure from the conventional view that lost profits are consequential, not general, damages in breach of contract cases.
