Privacy 

Torys’ Privacy Practice Group includes corporate lawyers and litigators with extensive experience in a wide range of areas concerning privacy rights, including personality rights; confidential information and trade secrets; freedom-of-information and privacy legislation; and a broad range of issues concerning e-commerce and the Internet.

The group has conducted several in-depth privacy audits for clients, and regularly advises on privacy issues relating to outsourcing and other technology transactions, including those related to the collection, use, disclosure or storage of personal information by service providers located outside of Canada. Our group also advises clients on

  • the requirements of privacy legislation on specific transactions and reorganizations, and on an ongoing basis
  • auditing of current corporate practices
  • the development of privacy policies and compliance plans
  • the enforcement of applicable laws

 

Canada’s Personal Information Protection and Electronic Documents Act dramatically modernized the country’s privacy laws and affects most companies that do business in Canada. We advise clients on the Act’s scope and application, as well as on related implementation issues. We are also very active in dealing with the increasing profile of privacy issues in North America generally, particularly in light of the perceived challenges to privacy posed by the Internet. Members of our group also have expertise in privacy protection compliance requirements in the United States and Europe.

We also represent clients in proceedings before the federal and provincial Privacy Commissions, including in complaints and investigations.

Our lawyers regularly speak on privacy law to industry and other associations.
